FanState Privacy Policy

Depending on how you interact with FanState, we may collect:

Account Information. Name, username, email address, phone number, account identifiers, authentication information, age or date-of-birth information where required, profile information, preferences, and account settings.

Transaction Information. Fan Point purchases, Fan Point balances, pack activity, spins, cards or rewards received, redemption history, order history, shipping information, refunds, promotions, and related transaction records.

Payment Information. Payments may be processed by third-party payment processors. FanState may receive transaction identifiers, payment status, billing information, payment method type, and limited payment-related information. We generally do not need to store complete payment-card numbers where payments are processed by third-party processors.

Collectible Information. Information concerning sports cards and other collectibles associated with your account, including digital representations, card descriptions, images, inventory identifiers, ownership or allocation records, shipping status, redemption information, and transaction history.

Watch Party and Event Information. When you participate in FanState watch parties or other real-world activations, we may collect event check-ins, QR-code scans, venue information, approximate location, timestamps, Fan Point activity, spins, rewards, redemptions, and engagement information. Where location permissions are enabled, we may process location information for fraud prevention, event verification, eligibility, personalization, or other disclosed purposes.

Device and Technical Information. We may automatically collect IP address, device identifiers, browser type, operating system, device type, language, referring URLs, pages viewed, session information, timestamps, crash information, network information, and similar technical data.

Usage Information. We may collect information about how you interact with FanState, including packs viewed or opened; Fan Points earned, purchased, or used; cards viewed; spins and outcomes; promotions entered; watch parties attended; QR codes scanned; links clicked; pages and features used; referral sources; creator or affiliate attribution; and advertising interactions.

Communications. We collect information you provide when contacting customer support, participating in surveys, communicating with us, submitting feedback, or otherwise interacting with FanState.

User Content. We may collect photographs, videos, comments, usernames, social content, reviews, or other materials you choose to submit.

Information From Third Parties. We may receive information from payment processors, authentication providers, social platforms, advertising partners, analytics providers, creators, affiliates, event partners, bars and venues, shipping providers, fraud-prevention providers, and other service providers and partners.

We may use information to: create and manage accounts; provide Fan Points and pack experiences; process transactions; allocate and manage collectibles; process redemptions and shipments; operate watch parties and events; verify attendance and eligibility; administer promotions; prevent fraud, abuse, duplicate accounts, and manipulation; secure FanState; provide customer support; personalize content and experiences; understand how users interact with FanState; measure product performance; perform analytics; attribute users and transactions to creators, campaigns, and referral sources; measure advertising effectiveness; advertise and market FanState; send transactional and promotional communications; develop and improve products; conduct research and statistical analysis; enforce our Terms; comply with legal obligations; resolve disputes; and protect FanState, our users, partners, and others.

We may use aggregated or de-identified information for lawful purposes and may retain and use such information where it cannot reasonably be linked to an identifiable individual, subject to applicable law.

FanState may use cookies, pixels, SDKs, local storage, APIs, and similar technologies.

These technologies may help us authenticate users, remember preferences, understand usage, prevent fraud, measure conversions, personalize experiences, and conduct advertising.

We may use advertising and analytics services such as Meta Pixel, Google Analytics, and similar technologies.

These technologies may collect or receive information concerning your device, browser, IP address, pages visited, interactions, referrals, registrations, purchases, and other events for measurement, attribution, analytics, and advertising.

Where required by applicable law, we will provide applicable consent or opt-out mechanisms.

We may disclose information to:

Service providers that perform hosting, cloud infrastructure, payments, authentication, analytics, customer support, communications, fraud prevention, shipping, storage, fulfillment, security, and other services for FanState.

Advertising and analytics partners that help us understand usage, measure campaigns, attribute conversions, reach audiences, and advertise FanState, subject to applicable law.

Creators and affiliate partners where necessary to measure referrals, calculate commissions, administer campaigns, or operate partnerships. We may provide aggregated or transaction-attribution information rather than directly identifying information where reasonably possible.

Bars, venues, event operators, and promotional partners where necessary to operate watch parties, validate rewards, verify eligibility, or administer events.

Collectibles partners including custodians, fulfillment providers, graders, marketplaces, sellers, and shipping providers where necessary to provide requested services.

Professional advisors including attorneys, accountants, insurers, auditors, and consultants.

Government and legal authorities when reasonably necessary to comply with law, legal process, regulatory obligations, enforce our agreements, investigate fraud, or protect rights and safety.

Corporate transaction participants in connection with an actual or proposed merger, acquisition, financing, investment, restructuring, bankruptcy, sale of assets, or similar corporate transaction.

We may also disclose information at your direction or with your consent.

We use administrative, technical, and organizational safeguards designed to protect personal information.

No internet transmission, storage system, website, or application can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

You are responsible for protecting your account credentials.

Depending on where you live and applicable law, you may have rights concerning your personal information, potentially including rights to request access, correction, deletion, portability, or information regarding certain disclosures or processing.

You may also have rights to opt out of certain marketing communications or advertising-related processing.

We may need to verify your identity before completing a request.

We will not unlawfully discriminate against you for exercising applicable privacy rights.

You may unsubscribe from promotional emails by using the unsubscribe mechanism included in those communications.

Even after opting out of promotional communications, we may send non-promotional communications concerning your account, transactions, security, legal notices, or Services.

FanState’s paid Services are not intended for children under 18.

We do not knowingly collect personal information from children under 13 in violation of applicable law.

If we learn that we collected personal information from a child in circumstances prohibited by law, we may delete it.

Parents or guardians who believe a child has provided personal information improperly may contact us via the website chatbot.

FanState may link to or integrate with third-party websites, applications, social networks, payment providers, venues, marketplaces, or other services.

Their privacy practices are governed by their own policies. FanState is not responsible for independent third-party privacy practices.

FanState is operated from the United States.

If you access the Services from another country, your information may be transferred to, stored in, or processed in the United States or other jurisdictions where FanState or its service providers operate.

Additional rights may apply depending on your location.

If FanState participates in a merger, acquisition, investment, financing, reorganization, bankruptcy, sale of assets, or similar transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law.

We may update this Privacy Policy from time to time.

We will update the Effective Date when changes are made and provide additional notice where required by law.
